Dear Club Secretary,

Following Board Statement 2 - Issued on 28th April 2011 in which the Board conveyed an undertaking that an EDM will be convened as soon as is prudent and practical after the delivery of the pending High Court decision and that you would be informed should anything significant occur in the interim, I write to advise you as follows:

HIGH COURT DECISION
Justice Roderick Murphy in a 35 page judgement delivered his High Court decision on Friday 13th May 2011 decided as follows:

"In the circumstances the court declines to grant any injunctive relief restraining the defendant from considering the investigators report relating to the plaintiff's employment and will also refuse any injunctive relief restraining the defendant from taking any steps in furtherance of any disciplinary procedure as against the plaintiff."

His decision is in the context of an application brought by Michael Scanlon Chief Executive against the Board seeking to restrain us from relying on the Independent Investigators Report as part of the disciplinary process now underway.

COST OF HIGH COURT PROCEEDINGS
The Judge decided that costs should be awarded against Michael Scanlon and in favour of the ICU.

DISCIPLINARY PROCESS
It is now possible for the Disciplinary Panel, a sub-committee of Board Members, to proceed and make a decision on all matters before it.

EDM
Please be assured that and EDM will be arranged and a full explanation given to all clubs and their members as soon as it is prudent to do so, regardless of the outcome of the disciplinary process now underway.
Should there be any significant events in the mean time all affiliated clubs will be advised accordingly.
